New York, NY – Alleged Nine Trey Gangsta Blood member Anthony “Harv” Ellison was convicted in October kidnapping and robbing Tekashi 6ix9ine in July 2018. Now, he reportedly wants a retrial.
According to Complex, Ellison’s legal team filed a motion on Monday (December 2) to have his conviction tossed out and get a new trial in the process.
Attorneys Deveraux Cannick and Calvin Scholar argue there was “insufficient evidence to connect Ellison to Nine Trey’s criminal acts.” During the initial trial, 6ix9ine discussed a confrontation with Trippie Redd that took place inside a Manhattan hotel lobby in November 2017.
6ix9ine (real name Daniel Hernandez) claimed Ellison “punched Trippie Redd in the mouth” during the melee. However, Ellison’s lawyers allege the Trippie beef was all a rouse.
“During trial, the government elicited testimony that Mr. Ellison was first hired as security after coming to the defense Mr. Hernandez during a staged publicity ‘beef’ between Hernandez and a rapper named Trippie Redd,” the court filings reportedly read. “The evidence was more than sufficient to establish that the ‘beef’ between Hernandez and Redd was a publicity stunt.
“The two rappers made songs about one another. Moreover, Redd’s own manager sent Redd’s location to Hernandez ostensibly so that there could be some type staged confrontation… After coming to Hernandez’ defense at the staged publicity event, Mr. Ellison became Hernandez’ bodyguard and part Hernandez’ entourage.”
Ellison has stated numerous times the entire kidnapping itself was staged. His co-defendant Aljermiah “Nuke” Mack, who was convicted narcotics trafficking and racketeering, also filed a motion on Monday (December 2) requesting an acquittal.
6ix9ine is expected to be sentenced on December 18. Due to his cooperation with the federal government, he could be out as early as the top 2020.
